The governing documents do not provide substantiated fence height limits, approved/disapproved fence materials, setbacks, post-cap rules, or specific fence color standards. They do require prior written Architectural Review Committee approval before any building, fence, wall, Unit, or other structure is commenced, erected, maintained, improved, altered, made, or done on the property. The ARC regulates external design, appearance, use, location, and maintenance of Units, Buildings, Common Areas, and other improvements. If the ARC fails to approve, modify, or disapprove a complete application in writing within 30 days, approval is deemed granted. Existing deck/patio fences are contemplated: the Association is responsible for repairing and maintaining deck and patio areas and any deck/patio fences, including painting and staining the outside/exterior surfaces. Common fences are also referenced as part of architectural-control/exterior-maintenance upkeep. Pet rules refer to an Owner's fenced deck or patio, and clotheslines must be confined to deck or patio areas and kept below the height of the deck or patio fence. The architectural request form asks owners to include project materials, colors, measurements, contractor information, anticipated dates, and a plot map; it also states owners are responsible for permits, property lines, 811 utility marking, and avoiding drainage impacts.
