Notes

The authoritative recorded Bay Colony (Marion County) CCR/plat found for the Indianapolis subdivision does not provide legible, general fence specifications for materials, colors, maximum heights, post caps, or approval timelines. The fence-related restriction that could be substantiated is the recorded sight-distance rule: no fence, wall, hedge, or shrub planting may obstruct sight lines at intersections/corner lots within the restricted triangular sight-distance area. The recorded plat/covenants also reserve utility/drainage easements and prohibit structures, plantings, or other materials that interfere with those easements, which may affect fence placement. A 2013 Indiana Court of Appeals decision for this same Bay Colony next to Eagle Creek Reservoir describes removal of a chain-link gate/fence in the lake-front access easement context, but it does not establish a general community-wide chain-link material ban.

Bay Colony Restrictive Covenants §8 (Sight Distance at Intersections) and §7 (Easements), recorded/approved 1977; Bay Colony Civic Corp. v. Pearl Gasper Trust, Indiana Court of Appeals, March 11, 2013

The process

How Bay Colony approval actually works.

Five steps — and the paperwork-heavy first three are on us.

  1. 1
Pull the covenants We do this for you
We check your HOA's actual fence rules first — height caps, materials, colors.
  2. 2
Site sketch + spec sheet We do this for you
Plot map with the fence line marked, plus the material/height/style page boards want to see.
  3. 3
ARC packet submitted We do this for you
Filed in your HOA's preferred format — you get copies of everything.
  4. 4
    Board review — 1 to 3 weeks
Bigger neighborhoods meet monthly; complete packets usually approve on the first pass.
  5. 5
    Approved — posts go in
Your install slot is held during review, so approval doesn't cost you the season.
