The cited recorded Declaration is for Autumn Creek in Marion County, Indiana, recorded August 21, 1997 as Instrument No. 1997-0115082. Section 3.D states that no fence, wall, or non-plant screening may be constructed or installed on a lot unless it complies with the Declaration and has advance Committee approval. Section 8.A(i) requires prior written approval before any fence, wall, or other improvement is constructed, placed, or altered, with plans/specifications showing location, dimensions, color, composition, and materials. Section 8.A(iii) governs fences and walls: all fences/walls, including decorative fences, rear yard perimeter fences, privacy fences, and screens, require Committee approval before construction. Front yard perimeter fencing is not permitted, but the Committee may approve decorative front yard fences compatible with other lot improvements. Rear yard perimeter fencing approved by the Committee must be uniform throughout the Development and consist only of black vinyl coated or similarly black coated chain link, 42 inches high, with black metal posts and top rails; no rear yard perimeter fencing may be installed nearer to the front of the dwelling than the rear foundation line. Privacy fences and/or patio screens may be approved adjacent to patios to secure privacy for the immediate patio area and may be up to 6 feet high. All fences, walls, and screens must be professionally installed to professional levels of quality, and final Committee approval may be withheld until final inspection. Section 4.N also prohibits any fence, wall, hedge, tree, or shrub within specified street-intersection sight-line triangles if foliage/obstruction would be between 2 and 6 feet above the street. Section 8.B requires the Committee to approve or disapprove proposed improvements within 30 days after all required information is submitted.
